Unfair Contract Terms Reform Presentation:
On Monday 30 October 2023, the Specialist Contractors Association in partnership with Lynch Meyer Lawyers, hosted a highly informative presentation at Lynch Meyer Lawyers on the imminent Unfair Contract Terms reform.
These reforms are effective from 10 November 2023.
The presentation, led by Charles Moran, shed light on the significance of these legal changes and offered practical guidance for contractors to navigate and avoid potential pitfalls within their contracts. The event played a crucial role in helping businesses prepare for the enhanced protections and penalties associated with unfair contract terms in the post-November 10 landscape.
The reforms have substantially broadened the scope of small businesses eligible for protection against unfair contract terms. Previously, the protection only applied to contracts involving a party with fewer than 20 employees, and values under $300,000. Now, the definition of small business includes those with up to 100 employees or turnovers below $10 million, eliminating the value restrictions. Claiming unfairness is now more accessible to a wider range of firms. A summary of the presentation is available by clicking here.
The reform enhances the position of subcontractors within the industry, fostering a fairer and more competitive marketplace.
